Fire Ban Status as of August 10, 2010:

The Board of Commissioners have lifted the Fire Ban in unincorporated areas of Fremont County.

In the event of a Fire Ban, the following restrictions will apply.

Fire Ban, Stage 1 Restrictions:

Allowed Activities:
1.  Open fires only at developed recreation sites or improved sites;
2.  Charcoal, propane or other contained fuel grill use;
3.  Open fires in metal fire rings in campgrounds and parks;
4.  Smoking only within an enclosed vehicle or building, at a developed recreation
     site, within a designated smoking area with an approved container for discarding
     of butts, or while stopped in an area at least three feet in diameter that is barren      or cleared of all flammable materials;
5.  Use of an approved spark arrestor for use of any internal combustion engine, only      if equipped with an approved spark arrestor;
6.  Outdoor welding and grinding with proper distance from combustible materials, as
     long as there is proper and appropriate fire protection and suppression
     equipment in place.

Prohibited Activities:
1.   All open fires, open burning and smoking if not specifically allowed above;
2.   All agricultural burning including but not limited to weeds, brush, grass;
3.   All burning of trash, waste, refuse or other debris;
4.   Use and/or discharge of fireworks or pyrotechnic device and solid fuel rockets;
5.   Use of any explosives;
6.   Open fires using rock ring burn pits;
7.   Recreational below ground cooking;
8.   Outdoor smoking except as specifically allowed above, including discarding of
      cigarette butts at any location or from any vehicle.

Fire Ban, Stage 2 Restrictions

Allowed Activities:
1.   Open fires only at developed recreation sites or improved sites;
2.   Charcoal, propane or other contained fuel grill use;
3.   Open fires in metal fire rings in Campgrounds and Parks;
4.   Outdoor smoking only within an enclosed vehicle or building, at a developed
      recreation site, within a designated smoking area with an approved container for
      discarding of butts, or while stopped in an area at least three feet in diameter
      that is barren or cleared of all flammable materials; 
5.   Use of an internal combustion engine, only if equipped with an approved spark
      arrestor;
6.   Outdoor welding and grinding with proper distance from combustible materials,
      as long as there is proper and appropriate fire protection and suppression
      equipment in place.

Prohibited Activities:
1.   Open fires or campfires except as specified above;
2.   Outdoor smoking except as set forth above inlcuding discarding of cigarette butts
      at any location or from vehicle;
3.   Use and/or discharge of any fireworks or pyrotechnic device and solid fuel
      rockets;
4.   Use of explosives;
5.   Welding and grinding, except as set forth above;
6.   Use of any internal or external combustion engine, including a chainsaw and/or
      other equipment without an approved spark arrestor. 
7.   Cross-country use of a motor vehicle off of a governmental designated route on
      public property;
8.   Parking off-road on public property is allowed only when parked in an area
      devoid of vegetation for a distance of 10 feet of the roadway or when parked
      overnight in a developed campground or at a trailhead that is devoid of
      vegetation.  
9.   All agricultural burning including but not limited to weeds, brush, and grass;
10. All burning of trash, waste, refuse or other debris;
11. Use of rock ring burn pits;
12. Recreational below ground cooking;

Fire Ban, Stage 3 Restrictions

Prohibited Activites:
1.   All open flames and fires, regardless of location or source of fuel;
2.   All outdoor smoking and smoking within vehicles including discarding of cigarette
      butts at any location or from any vehicle;
3.   Propane, charcoal or other fuel grill use;
4.   All outdoor use of equipment or machinery with an internal combustion engine;
5.   All outdoor welding and grinding;
6.   Recreational below ground cooking;
7.   All agricultural burning including but not limited to weeds, brush, and grass;
8.   All burning of trash, waste, refuse or other debris;
9.   All use and/or discharge of any fireworks or pyrotechnic device and solid fuel
      rockets;
10. Use of explosives;
11. Cross-country use of a motor vehicle off of a governmental designated route on
      public property;

Any area of public lands under Stage 3 open fire/burning restriction shall be closed to all entry except for individuals carrying a written permit, Federal, State and Local officers or members of organized search and rescue or firefighting forces performing official duties and resident landowners and lessees.

Exceptions    

The following are exceptions under the fire ban ordinance:

a.   Sale of fireworks and fireworks displays properly permitted pursuant to Section
      12-28-103, C.R.S. 

b.   Burning of explosive wastes by the manufacturer of explosives in areas zoned
      for industrial use, when the burning is supervised by a fire department or fire
      protection district.

c.   Open fires or open burning by any federal, state or local officer, or member of an
      organized fire protection district or department in the performance of an official
      fire suppression or training function.                

Enforcement & Penalty for Violations

The ordinance shall be enforced by the Fremont County Sheriff, Undersheriff, and deputies.   Any person who violates this ordinance commits a class 2 petty offense under Colorado law and upon conviction shall be punished by a fine of not more than $1,000.00 for each separate violation.
