The Fremont County Sheriff’s Office can only serve civil papers within Fremont County. Fees for service must be paid in advance in accordance with C.R.S. 30-1-116. A billing account may be established by a licensed attorney or licensed collection agency with a principle office located in the State of Colorado in accordance with C.R.S. 30-1-106 and H.B. 1057. Accepted forms of payment are: money orders, cashier checks, business checks (with business name imprinted), attorney trust account checks, and local bank checks (Fremont County). Out of County personal checks will not be accepted and will be returned.  You may mail or personally deliver papers to the Fremont County Sheriff’s Office; Civil papers are received only at the main Sheriff's Office complex in Cañon City.  Faxes are only accepted for Protection Orders with proof that court order fees have been waived.

Please complete the Civil Information form provided or send a cover letter with information which will assist us in successfully serving your papers.  This information should include person or persons to be served, physical address, place of employment, phone number, work hours, etc and your return information (name, address and telephone number).  The more information you provide will help increase the chances for a successful service. Your return of service will be mailed back along with your statement; please provide a self addressed stamped envelope. Any additional fees will be billed and included on your statement. We will hold your papers for pick up if directed.  It is your responsibility to see the documents are filed with the court. If service is unsuccessful, a partial refund will be mailed to you by the Fremont County Finance Office.

Fees are based on Colorado Revised Statutes pursuant to C.R.S. 30-1-106 and House Bill 10-1057.  Please make payment payable to Fremont County Sheriff’s Office.

If Serving TWO OR MORE PAPERS on the same person or on a different person AT THE SAME TIME AND PLACE AND IN THE SAME ACTION (SAME COURT CASE NO.) the fee will be:

  1. The highest allowable fee for the first process.
  2. An additional $10.00 for each additional process.
  3. One mileage fee for each attempt made in an operational period.


Mileage Fees:

Mileage fee for each mile actually and necessarily traveled in serving a Criminal Action is $0.50 per mile.


APPENDIX “A”

“Zone Based” mileage fees for the service of civil process by Sheriff’s deputies are based on roundtrip mileage from the Fremont County Sheriff’s Office, 100 Justice Center Road to a center point in each of the Sheriff’s Office’ patrol districts (zone).  It is then rounded to the nearest mile (see calculated mileages below).

The fee assessed will be calculated based upon the round trip mileage established for the address where the paper is to be served in the applicable  patrol zone, multiplied by the current mileage rate set pursuant to 30-11-107 (1)(t).  This is regardless of the number of attempts made, or the actual number of miles traveled by the deputy in effecting service per operational period (per shift), for that day.  It is the customer’s responsibility to inform the Sheriff’s Office Civil Section of the number of attempts for each paper to be served.

The Sheriff’s Office Substation is located at 050 County Road 50 Cotopaxi, CO 81233. The 1st mileage charge and attempt will be calculated from the Sheriff’s office main building at 100 Justice Center Road, Canon City to the center points in each zone. Any additional mileage charges; thereafter, will be based on a roundtrip from the substation to the center point in each patrol zone. (See calculated mileage below).
